Terms of Service

1.1. Platform/Website: Refers to StarBells Gallery, an online marketplace acting as an intermediary between Armenian artists and global buyers.

1.2. User/Buyer: Any individual or entity accessing the Platform to view or purchase artwork.

1.3. Seller/Artist: The creator of the artwork listed on the Platform, responsible for its quality, condition, and delivery.

1.4. Artwork: Original works of Armenian art, including paintings, sculptures, photographs, and other creative products available for purchase.

1.5. Order: A purchase request by the Buyer, constituting acceptance of this Agreement and forming a contract for the sale and delivery of selected Artwork.

2.1. By using the Platform, Buyers and Sellers agree to these Terms of Service and enter into a legally binding agreement with StarBells Gallery.

2.2. This Agreement represents a public offer in accordance with U.S. and Armenian law. By placing an Order, Buyers accept these terms, and Sellers agree to fulfill the Order upon confirmation of sale.

2.3. The Platform reserves the right to modify these Terms at any time. Changes will be posted on the Website, and continued use constitutes acceptance of the revised Terms.

3.1. Listing Accuracy: Sellers must ensure all Artwork details, including images, dimensions, and descriptions, accurately represent the item.

3.2. Availability: Artwork is subject to availability. If unavailable, the Buyer will be notified, and the purchase price will be fully refunded.

3.3. Visual Disclaimer: Images may vary slightly due to screen settings or lighting. Minor discrepancies do not constitute grounds for return.

4.1. Order Submission: Buyers must select Artwork, complete the checkout form, and confirm payment.

4.2. Payment Methods: Payments are processed securely through third-party providers. The Platform does not store payment information. Payments are processed in USD.

4.3. Order Confirmation: Buyers will receive an email confirmation after placing an Order. Availability is confirmed upon Seller verification.

4.4. Pricing and Taxes: Prices are listed in USD. Purchases shipped within the U.S. are tax-free. Buyers outside the U.S. are responsible for covering import duties, taxes, and other applicable fees.

5.1. Shipping Responsibility: Sellers are responsible for packaging and shipping the Artwork.

5.2. Delivery Terms: Estimated delivery times and tracking details will be provided when available.

5.3. Shipping Costs: Shipping fees are based on size, weight, and destination and are displayed at checkout. Buyers are responsible for all customs charges.

5.4. Risk of Loss: Title and risk of loss transfer to the Buyer upon delivery to the carrier.

5.5. Delivery Issues: The Platform assists in communication regarding delivery issues but is not liable for delays caused by customs, carriers, or other unforeseen factors.

6.1. Final Sale Policy: All sales are final unless:

• The item arrives damaged due to improper packaging.
• The delivered item differs significantly from its description.

6.2. Return Procedure: Buyers must notify the Platform within 5 days of receiving a damaged or incorrect item. Photographic evidence may be required.

6.3. Refunds: Approved refunds will be issued after the Seller receives the returned item.

6.4. Case-by-Case Review: Refund requests are reviewed at the Platform's discretion.

7.1. Platform Role: The Platform acts as an intermediary and does not guarantee the authenticity, quality, or condition of the Artwork.

7.2. Seller Responsibility: Sellers are responsible for listing accuracy, item condition, and compliance with export regulations.

7.3. Indemnification: Buyers and Sellers indemnify the Platform from claims, losses, or damages arising from transactions.

8.1. The Platform, Buyers, and Sellers agree to adhere to applicable laws of the U.S. and Armenia.

8.2. Export Compliance: Sellers must comply with Armenian export regulations.

8.3. Import Compliance: Buyers outside the U.S. are responsible for understanding and complying with import regulations, including customs fees.

9.1. Data Collection: User data is collected and processed for transaction fulfillment and support, in compliance with U.S. and Armenian laws.

9.2. Third-Party Sharing: User data is only shared when necessary to fulfill orders or comply with legal requirements.

9.3. Data Security: The Platform maintains robust measures to protect user data.

10.1. Right to Amend: The Platform may update these Terms at any time.

10.2. Notification: Material changes will be communicated via email or Website notification.
